Terms of Service

These Terms of Service ("Terms") govern your use of Toqui, an AI-powered travel companion operated by Galloway Software Solutions Inc. ("we," "us," or "our"). By accessing or using Toqui, you agree to be bound by these Terms. If you do not agree, please do not use the service.
1. Acceptance of Terms
By creating an account, accessing the website, or using the Toqui application, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. Eligibility
You must be at least 18 years of age to use Toqui. By using the service, you represent and warrant that you are at least 18 years old. If you are under 18, you may not use the service.
3. Account Responsibility
You must sign in with a Google account to use Toqui. You are responsible for:
- Maintaining the security of your account credentials
- All activity that occurs under your account
- Notifying us promptly of any unauthorized use of your account
You may not share your account with others or allow others to access your account. One account per person.
4. Service Description
Toqui is an AI-powered travel companion that helps you plan trips, manage bookings, and get location-aware recommendations. The service includes chat-based interaction with AI personas, itinerary generation, and booking ingestion.
Toqui offers a free tier with limited features and paid tiers with expanded capabilities. See Section 8 for pricing details.
5. AI-Generated Content
Toqui uses artificial intelligence to generate travel recommendations, itineraries, and conversational responses. By using the service, you acknowledge and agree that:
- Accuracy is not guaranteed. AI-generated content may contain inaccuracies, including incorrect addresses, outdated opening hours, wrong prices, or obsolete information.
- Verify critical details independently. Always confirm visa requirements, safety advisories, booking confirmations, flight times, and any other critical travel details through official sources before relying on them.
- Recommendations are suggestions, not guarantees. We do not guarantee the availability, quality, safety, or suitability of any place, service, or experience recommended by the AI.
- AI personas are fictional characters. Toqui and its expert guides are AI-generated personas, not real people. Their "opinions" and "experiences" are generated content.
- Not professional advice. Toqui does not provide professional travel advice, legal advice, medical advice, or any other professional services. Consult qualified professionals for such needs.
6. Booking Disclaimer
Toqui is not a travel agency, tour operator, or booking platform. We facilitate discovery and planning, not transactions. We do not:
- Sell travel products or services
- Guarantee prices, availability, or booking terms
- Act as an agent for any travel provider
- Process payments for travel bookings
Any bookings you make through third-party links are transactions between you and the provider, subject to their own terms and conditions.
7. Affiliate Links
Toqui may include links to third-party travel services such as booking platforms, tour operators, and car rental services. Some of these links are affiliate links, meaning we may earn a commission if you make a purchase or booking through them. This does not affect the price you pay.
Affiliate relationships do not influence recommendations for Trip Pro (paid) users, who receive unbiased recommendations from any source. Free tier recommendations may prioritize affiliate partner offerings.
8. Payments and Pricing
8.1 Free Tier
The free tier includes limited daily messages, access to the Toqui orchestrator and a limited number of expert guide interactions per trip, and affiliate-only booking recommendations.
8.2 Trip Pro ($12 per trip)
Trip Pro is a one-time, per-trip purchase that unlocks expanded features for a single trip, including:
- Unlimited messages
- Access to all 800+ expert guide personas
- Email forwarding for booking ingestion
- Trip data export
- Unbiased recommendations from any source (not limited to affiliate partners)
8.3 Annual Pass ($49 per year)
The Annual Pass unlocks Trip Pro features for all trips created within the subscription period. It is offered as an option for frequent travelers.
8.4 Refund Policy
Trip Pro purchases are non-refundable once AI features have been used for that trip. If you have not used any AI features after purchase, you may request a refund within 7 days by contacting support@toqui.travel. Annual Pass refunds are handled on a case-by-case basis.
8.5 Price Changes
We reserve the right to change pricing at any time. Price changes do not affect existing Trip Pro purchases. Annual Pass holders will be notified of any price changes at least 30 days before their renewal date.
9. Acceptable Use
You agree not to:
- Use the service for any unlawful purpose
- Attempt to extract, scrape, or reverse-engineer the AI models or service
- Use automated tools, bots, or scripts to access the service
- Use the service to generate harmful, abusive, or misleading content
- Share your account credentials with others
- Circumvent rate limits or other technical restrictions
- Impersonate any person or entity
- Interfere with or disrupt the service or its infrastructure
10. Your Content
You retain ownership of all content you provide to Toqui (trip descriptions, messages, booking data). By using the service, you grant us a limited, non-exclusive license to process this content solely to provide the service to you.
We do not use your content to train AI models. See our Privacy Policy for details on how your data is handled.
11. Intellectual Property
The Toqui service, including its name, logo, AI personas, user interface, and underlying technology, is the intellectual property of Galloway Software. You may not copy, modify, distribute, or create derivative works based on our service without prior written consent.
AI-generated responses provided to you through the service may be used freely for your personal travel planning purposes.
12. Service Availability
We strive to keep Toqui available at all times but do not guarantee uninterrupted service. We may modify, suspend, or discontinue any part of the service at any time. We will make reasonable efforts to notify you of significant changes.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Galloway Software Solutions Inc. and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss or damage arising from reliance on AI-generated recommendations
- Missed flights, incorrect bookings, or travel disruptions
- Costs incurred based on AI-suggested itineraries
- Personal injury or property damage arising from recommended activities
- Data loss beyond what is described in our data retention policy
- Issues arising from third-party services, affiliate partners, or booking providers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. Our total aggregate liability for any claim arising from your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim, or CAD $100, whichever is greater.
14. Indemnification
You agree to indemnify and hold harmless Galloway Software Solutions Inc. from any claims, damages, losses, or expenses arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.
15. Termination
You may delete your account at any time through the app settings. We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion, with reasonable notice when possible.
Upon termination, your data will be handled as described in our Privacy Policy. Sections that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will continue to apply.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
17. Dispute Resolution
Any dispute arising from or relating to these Terms or your use of the service shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved through negotiation within 30 days, it shall be submitted to the exclusive jurisdiction of the courts of British Columbia, Canada.
18. Modifications to Terms
We may update these Terms from time to time. Material changes will be communicated via the app or email at least 30 days before they take effect. Continued use of the service after the effective date of changes constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you should stop using the service and delete your account.
19. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Galloway Software Solutions Inc. regarding the use of Toqui and supersede any prior agreements.
